DWI
General Information
If
you are arrested for a DWI, you must defend yourself in
two (2) forums:
State Criminal Court & the Department
of Motor Vehicles License Suspension Hearing.
1st
Time Arrest:
State Criminal Court: There is a diversionary
Pretrial Court Program Available;
Department
of Motor Vehicles License Suspension Hearing: Will
seek to suspend your license for a minimum of 90 days. A
Work Permit: May be granted or not at sole
discretion of the Motor Vehicle Department. The Work License
may be available IMMEDIATELY if fail chemical testing, but
if you refuse testing you must serve a percentage ofyour
suspension time.
2nd
Time Arrest:
State Criminal Court: If ten years after
your 1'st arrest AND you used the diversionary program to
resolve that case, a SECOND TIME DIVERSIONARY PROGRAM
is available, otherwise: a guilty plea or finding results
in Two (2) days in jail or 100 hrs. community service, one
year probation & one year suspension of license; plus
Department of Motor Vehicles License Suspension
Hearing.
3rd
Time Arrest: Four Months in Jail (Legislature may
change soon); plus Department of Motor Vehicles
License Suspension Hearing.
